Terms of Use

1. Scope

These Terms of Use apply to the use of this website, a service for sharing images via links for a limited period of time, optionally protected by a password. The operator is MOSKITO LLC.

2. Description of Services

Registered users can upload images and create links that remain valid for a selectable period of time and can optionally be protected with a separate password. Recipients do not need their own account to view shared images via a valid link.

3. Registration

Registration requires a nickname and an actually accessible email address (for security codes and/or account recovery). A real name is not required. Use of the service is permitted only to persons of legal age or to persons with the consent of a parent or legal guardian.

4. User Obligations

• No content may be uploaded that violates applicable law, infringes the rights of third parties (in particular copyright, personality, and image rights), or depicts persons without their consent.
• Share links and any link passwords provided must be treated confidentially and only shared with the intended recipients.
• The service may not be used for automated mass access, attempts at misuse, or to circumvent access restrictions.

5. Measures Taken by the Operator

The operator may block and delete images that violate these Terms of Use or applicable law; blocked images cannot be shared again, even through a new link. In the event of serious or repeated violations, the account may be deactivated or deleted.

If the operator becomes aware, for example through a report of shared content, of content that gives rise to a suspicion of a criminal offense, the affected files and associated account data will be isolated for the purpose of preserving evidence and retained for as long as required for a possible review procedure; they will only be disclosed pursuant to a judicial order. After completion of the evidence-preservation process, the files will be recursively deleted.

In the event of misuse, the operator may permanently exclude the affected email address from registration.

6. Availability

The service is operated with reasonable care; uninterrupted availability is not guaranteed. Maintenance work or technical problems may result in temporary outages.

7. Liability

The operator shall be liable without limitation for intent and gross negligence and in accordance with the provisions of the Product Liability Act. Otherwise, the operator shall only be liable in the event of a breach of an essential contractual obligation (cardinal obligation), limited to foreseeable and typical contractual damages. The service may be discontinued at any time without giving reasons.

8. Deletion of Content and Accounts

Users can delete individual images and revoke individual links at any time via the dashboard. The entire account can also be deleted there at any time; login access, links, and images will be blocked from that moment onward. For further details, please refer to the Privacy Policy.

After an account has been deleted, the same email address may be used again for a new registration, provided that it has not been blocked due to misuse. The previous nickname remains blocked for 14 days.

9. Changes to These Terms of Use

The operator may amend these Terms of Use with effect for the future, for example in the event of changes to the scope of services or the legal situation. Users will be informed of material changes.

10. Applicable Law and Final Provisions

The law of the district court having jurisdiction over the service shall apply. Should individual provisions of these Terms of Use be invalid, the validity of the remaining provisions shall remain unaffected.
